IR35

What changes have been made?
Following the 2017 IR35 reforms in the public sector, HMRC will extend these rules to the private sector starting April 6, 2021. The reforms shift responsibility for assessing employment status to clients, affecting public sector organizations and medium and large private companies. Small private companies are exempt.


How does this affect contractors?
From April 6, 2021, clients, not contractors, will determine IR35 status. If inside IR35, full tax and NIC must be deducted from the worker's pay. HMRC provides guidance and the CEST tool for assessment.


What is considered to be a small company?
Small private companies are exempt from the legislative changes if they meet two or more of the following criteria, as defined in The Companies Act 2006:

Turnover of £10.2m or less

Balance sheet total of £5.1m or less
-
50 or fewer employees
In these cases, the PSC remains responsible for determining the IR35 status.


Does this effect umbrella companies?
Umbrella companies directly employ their workers, so the off-payroll working rules don't apply. These regulations only affect self-employed contractors.
